What Jobcom is

Jobcom is a Labour Market Testing advertising and evidence platform. It helps you advertise roles, capture applications securely, record screening decisions and assemble evidence.

Jobcom does not provide legal or migration advice, does not make eligibility decisions, and does not guarantee any immigration, sponsorship, nomination or visa outcome. You and your advisers remain responsible for confirming the requirements that apply to you, and for deciding whether any advertisement and its supporting evidence meet those requirements.

Advertisement preparation and automated features

Jobcom prepares advertisements and supporting documents using structured information you provide, together with publicly available occupational data such as the ANZSCO classification. These are drafts for your review. No advertisement is published, and no evidence is finalised or sent, until it has been reviewed and approved by the responsible parties.

Some steps may be automated, including preparing draft wording, routing applications, and assembling evidence. Automated output is provided to assist you and is not a substitute for your own review. You are responsible for checking that any advertisement, screening decision or evidence document is correct and appropriate before you rely on it or submit it to any third party, including the Department of Home Affairs.

Applicant screening and delivery

Where you choose screened delivery, Jobcom may automatically forward to you only those applications that meet the criteria you set, and hold the rest for review. This is a delivery and administrative convenience only. Jobcom does not reject applicants, does not assess suitability, and makes no representation about any applicant. All applications are retained and remain available to you; the decision on any applicant is yours.

Your responsibilities

You are responsible for the accuracy of the role information you provide, for approving the advertisement before it runs, for reviewing any evidence before it is relied upon or submitted, and for the lawful use of applicant information you receive through the platform.

Warranties and liability

Jobcom is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Jobcom excludes all warranties not expressly set out in these terms, including any warranty that the platform will be uninterrupted, error-free, or that any advertisement, screening result, monitoring record or evidence document will be accepted by any third party or achieve any particular outcome.

Nothing in these terms excludes any right or guarantee that cannot lawfully be excluded, including under the Australian Consumer Law. Where Jobcom is liable under a non-excludable guarantee, and the law permits, our liability is limited to resupplying the affected service or paying the cost of having it resupplied.

To the maximum extent permitted by law, Jobcom is not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, opportunity, goodwill, or any immigration, sponsorship, nomination or visa outcome, arising from your use of the platform. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the platform is limited to the fees you paid to Jobcom for the campaign giving rise to the claim.

Indemnity

You agree to indemnify Jobcom against claims, losses and costs arising from your breach of these terms, from information you provide, from an advertisement or evidence you approved, or from your use of applicant information, except to the extent caused by Jobcom.

Acceptable use

You agree not to misuse the platform, attempt to access data you are not authorised to see, or upload unlawful or harmful content. Access is controlled per organisation and per campaign.

Fees

Campaigns are quoted before they begin and invoiced as described in our pricing. Fees are exclusive of GST unless stated otherwise.

Changes

We may update these terms. Where a change is material, we will make the updated terms available and record the effective date.
